Bill to make Provision for the Regulation and Improvement of Communications within the Elwynnese Union [23 Gevraquun 1637] [Royal Assent granted on 12 Elroqpinu 1637]

BE IT ENACTED by the King's most Excellent Majesty, by and with the advice and consent of the Sænators of the Sænate of the Elwynnese Union, in this present Royal Parliament assembled, and by the authority of the same, as follows:

An Act to make Provision for the Regulation and Improvement of Communications within the Elwynnese Union.

  1. Short Title
  2. This Act may be cited as "The Elwynnese Communications Network (Elwnet) Act, 1637."

    Assertion of Right
  3. The Elwynnese Communications Network, or Elwnet, is the integrated totality of all viable communications technologies operated within the Elwynnese Union.
  4. Communications technologies shall include all forms of broadcast media operated within the Elwynnese Union.
  5. The physical infrastructure of the Elwnet and the principle of its operation is, by incontestable right under this Act, the exclusive property of the People of Elwynn.
  6. In the name of the People that right is hereby asserted by His Riverine Majesty in Council on behalf of the Elwynnese Union.

    Governance
  7. His Riverine Majesty in Council shall appoint a person of suitable bearing to the post of His Riverine Majesty's Postmaster General.
  8. It shall be the right of His Riverine Majesty's Postmaster General to exclusively maintain all forms and channels of communication including telecommunications and broadcasting.
  9. His Riverine Majesty in Council may graciously appoint Lords Commissioners to the exercise of the powers of His Riverine Majesty in Council with regards to the regulation of the Elwnet and the direction of His Riverine Majesty's Postmaster General within matters pertinent to his remit.
  10. The Postmaster General may licence the creation of public communication services carried on the Elwnet by public and territorial bodies of the Elwynnese Union with a remit for a particular jurisdiction and also carrying of broadcast and communication services by chartered and private companies.
  11. It shall be lawful for His Riverine Majesty's Postmaster General and he is hereby authorized, with the Consent of the Lords Commissioners of His Riverine Majesty in Council, from Time to Time, out of any Monies which may be from Time to Time appropriated by Act of the Royal Parliament and put at his Disposal for that Purpose, to purchase for the Purposes of this Act, the whole, or such Parts as he shall think fit, of the Undertaking of any Company, and any Undertaking, and all other Property purchased under the Powers of this Act, shall be vested in and held by His Riverine Majesty's Postmaster General, in his corporate Capacity, and his Successors: Provided always, that no such Purchase be made, and that no Agreement other than the Agreements confirmed by this Act for any such Purchase be binding, unless the said Agreement, accompanied by a Minute from the Lord Commissioners of His Riverine Majesty in Council, in which the Grounds of the Agreement shall be set forth, shall have lain for One Elw Year on the Table of both His Riverine Majesty in Council and the Sænate of the Elwynnese Union without disapproval.
  12. Any Company, with the Authority of Two Thirds of the Votes of their Shareholders present in person or by proxy at a General Meeting of the Company specially convened for the Purpose, may sell all or any Portion of their Undertaking to the Postmaster General for such Sum of Money as may be mutually agreed upon between the Postmaster General and the Company; and the Execution by any Company under their Common Seal of a Conveyance to the Postmaster General, duly stamped, of their Undertaking, shall be sufficient to vest the same in the Postmaster General for all the Estate, Right, Title, and Interest of the Company therein, with all incidental Rights, Privileges, and Easements, and the same may be used, exercised, and enjoyed by the Postmaster General in the same Manner and to the same Extent as the same respectively are, or if this Act had not been passed might be held, used, exercised, and enjoyed by any Company, and the Receipt of Two of the Directors of any Company for the Purchase Money, endorsed upon the Deed of Conveyance, shall be a sufficient Discharge for the same to the Postmaster General, who shall not be bound to see to the Distribution thereof.

    Licencing
  13. Where the Worshipful Corporation of Aldermen for a Bailiwick is licenced by His Riverine Majesty's Postmaster General to provide a system of public communication, they may defray the expenses of exercising the powers in the case of the Bailiwick out of the Bailiwick's revenues or a rate of local taxation out of which the general expences of the Bailiwick are defrayed, and may borrow money for the purpose.
  14. There shall be a system of licencing for the receipt and the sending of any and all forms of communication within the Elwynnese Union by residents and visitors.
  15. For a fee of one hundred and fifty Florins, a resident or visitor may, on application to the Postmaster General, receive a licence to send and receive correspondence in all forms carried on the Elwnet. Said correspondence shall carry a stamp in the signature of the sender, indicating that duty has been paid for the 'Correspondent's Licence Fee'. Any and all applications for a Correspondents Licence shall be granted provided that the applicant enjoys the rights of permanent residency and or visitation accorded by the Decree of Llaq Enderion.
  16. For a fee of five hundred florins, a resident may, on application to the Postmaster General, receive a licence to produce and disseminate broadcast media, in the form of written, audiable or visual communication, other than correspondence, carried on the Elwnet. Said broadcast media shall carry a stamp, displayed within the body of the work, indicating that duty has been paid for the 'Broadcaster's Licence Fee'.
  17. The Postmaster General may revoke the licence of any Broadcaster found guilty of an offence against His Riverine Majesty or if the Broadcaster is censured by the Court of Star Chamber for any statement or expression contained in the output of the Broadcaster that is contrary to the values of Societal Harmony and the pluralism and liberty that is the common right of all mankind and the best reflection of the Grace of the Divinity of the Lady Elwynn Herself.
  18. Correspondence and Broadcast Media issued within the Elwynnese Union without the appropriate 'duty paid' stamp will be transferred to His Riverine Majesty's Goal at Dragonsfold and held there until the appropriate licence has been sought and granted.
Bill to transfer the Bailiwick of the Vale of Angularis and the administration of the City of Scoglitto to the Emirate of Alalehzamin and Utasia [19 Oskaltequ 1638] [Royal Assent granted on 24 Oskaltequ 1638]
BE IT ENACTED by the King’s most Excellent Majesty, by and with the advice and consent of His Councillors of Eliria, acting as Sænators of the Union, and the Representatives of the Elwynnese Nation, in the present Royal Parliament assembled, and by the authority of the same, as follows:

An Act to transfer the Bailiwick of the Vale of Angularis and the administration of the City of Scoglitto to the Emirate of Alalehzamin and Utasia.

1. Short title
This Act may be cited as the Angularis Transfer Act 1638.

2. Transfer
The Bailiwick of the Vale of Angularis is transferred from the Kingdom of Amokolia to the Emirate of Alalehzamin and Utasia.

3. Scoglitto

The responsibility for the administration of the City of Scoglitto is transferred from the Kingdom of Amokolia to the Emirate of Alalehzamin and Utasia.

BE IT ENACTED by the King’s most Excellent Majesty, by and with the advice and consent of His Councillors of Eliria, acting as Sænators of the Union, and the Representatives of the Elwynnese Nation, in the present Royal Parliament assembled, and by the authority of the same, as follows:

An Act to update the organization of Bailiwicks and the Judiciary in the Union

Chapter 1: Subdivisions

Section 1: Municipal Corporations
1. The Union shall continue to be divided into a number of municipal corporations known as Bailiwicks or Communes.

2. The municipal corporations are listed in the First Schedule to this Act and their borders are depicted on the Second Schedule to this Act.

3. The powers and responsibilities of the municipal corporations shall be determined by or under Royal Law.

4. The Royal Governor of each Royal Precinct shall have the power to establish the official long-form names of the municipal corporations in zir Royal Precinct.

Section 2: Royal Precincts
1. Two or more municipal corporations may be enjoined, by Royal Law, into a Royal Precinct. The names of the Royal Precinct are listed the Third Schedule to this Act, and the borders of precincts are listed the Second Schedule to this Act.

2. Any Royal Precinct shall be headed by a Royal Governor. Save for those Royal Precincts which are vested in the White Orchid Throne, any Royal Governor shall be appointed by the King in the Council of Eliria "(hereafter "the King in Council") and shall hold either a republican or noble title associated with such Royal Precinct.

3. There shall be listed in the Fourth Schedule to this Act one republican and one noble title for each Royal Precinct. Persons who belong to nobility or royalty shall have the option to hold a noble title, while commoners may only be elevated to a noble title on the advice and consent of the Council of Eliria.

3. Royal Governors who are appointed to a noble governorship shall hold the position for life, and may, on achieving the consent of the Sænate, make rules for succession of that title, provided that the Sænate shall always hold power to overrule such instrument of succession, and appeal to the King in Council to appoint a new Royal Governor.

4. Where there is a republican title-holder of a Royal Precinct, a member of the Elwynnese nobility or royalty may be appointed to the titular noble title of that precinct, if in the view of the King in Council, he or she is associated with such Royal Precinct by zir own birth or residence, or if one or more of his or her parents or grandparents have been born there or resided there, or if there are other special considerations, as long as that the governor assents to it.

Section 3: Circuits
Those Royal Precincts which have more than twenty municipal corporations, or have a population higher than twenty-five million residents, or stretch over a large geographic area, or cover more than one time zone, may by Royal Law be divided into two or more circuits, provided that no circuit shall cover less than five municipal corporations. The names, borders and numbers of circuits are established by Royal Law.

Chapter 2: The Royal Courts of Justice

Section 1: Delegation of Judicial Powers
1. The judicial powers of the Elwynnese Union shall be delegated by the King to the Royal Courts of Justice, to wit: the Court of Star Chamber and the Court of Castle Chamber as well as the subordinate Law Courts existing within the aforesaid Courts of Law.

2. The Royal Courts of Justice shall have such powers as are conferred upon the aforesaid courts of law by or under Royal Law.

Section 2: Commandery Courts and Assize Courts
1. Upon the coming into operation of this Act, there shall stand established within the Court of Star Chamber a number of Commandery Courts and Assize Courts.

2. The number of Commandery Courts shall always correspond with the number of municipal corporations of the Flower of the North. Likewise shall the number of Assize Courts always correspond with the number of Royal Precincts and Circuits of the Lands of the Two Sacred Rivers.

3. The jurisdiction of the Commandery Courts and the Assize Courts includes such matters as would be tried by the Court of the King's Bench sitting as a Court of Justiciary.

Section 3: Arches Courts and Marshalsea Courts
1. Upon the coming into operation of this Act, there shall stand established within the Court of Castle Chamber a number of Arches Courts and Marshalsea Courts.

2. The number of Arches Courts shall at all times correspond with the number of municipal corporations of the Jewel of the Many Facets. Likewise shall the number of Marshalsea Courts always correspond with the number of Royal Precincts and Circuits of the Lands of the Two Sacred Rivers.

3. The jurisdiction of the Arches Courts and the Marshalsea Courts includes such matters as would be tried by the Court of the King's Bench sitting as a Court of Session, or Court of Review, or Court of Admirality.

Section 4: Appeals
1. An appeal shall lie to the competent Assize Court to any judgement, decree, order, ruling or any other decision of a Commandery Court. Likewise may any such judicial decision by an Assize Court be appealed to the Court of Star Chamber.

2. An appeal shall lie to the competent Marshalsea Court to any judgement, decree, order, ruling or any other decision of an Arches Court. Likewise may any such judicial decision by an Marshalsea Court be appealed to the Court of Castle Chamber.

3. Any judgement, decree, order, ruling or any other decision of the Court of Star Chamber or the Court of Castle Chamber may be appealed to the Imperial Judex.

Section 5: Statement of Clarification
For greater legal certainty, Arches Courts, Commandery Courts, Assize Courts and Marshalsea Courts shall exist solely for the purposes of the simulation.

Section 6: In the Name of the King
Judicial decisions rendered by the Royal Courts of Justice shall be declared publicly in the name of the King and enforced in the same name.

Section 7: Crown Immunity
The King shall continue to enjoy full and absolute Crown Immunity.

Chapter 3: The Court of Castle Chamber

Section 1: King's Master of the Judicial Rolls and Records of Elwyna
The Court of Castle Chamber shall continue to be headed by the King’s Master of the Judicial Rolls and Records of Elwyna, who shall be His Riverine Majesty's Advocate in the process known as litigation when presenting the case against a respondent to a superior court.

Section 2: Royal Deemsters
In addition to the King's Master of the Judicial Rolls and Records of Elwyna, the Court of Castle Chamber shall also continue to be composed of Royal Deemsters.

Section 3: Appointments and Removals
3.The King's Master of the Judicial Rolls and Records and the Royal Deemsters shall be appointed and removed by the King in Council. Any of the aforesaid judicial officials shall also cease to hold office upon zir death or resignation from zir office.

Section 4: Seats of Royal Deemstries
Each of the several Royal Deemstries in the Court of Castle Chamber - to which, for the purposes of the simulation, both persons and characters may be appointed to - shall correspond with a Royal Precinct or a Circuit.

Section 5: Acts of Sederunt
The Court of Castle Chamber may by Act of Sederunt lay down rules and regulations on its procedure as well as those of the Arches Courts and Marshalsea Courts that are not covered by Royal Law.

Chapter 4: The Court of Star Chamber

Section 1: Royal Instructing Justice of Elwynn
The Court of Star Chamber shall continue to be headed by the Royal Instructing Justice of Elwynn.

Section 2: His Riverine Majesty's Advocate
1. With regard to the persecution and punishment of the enemies of the present Ayreon-Kalirion Monarchy as well as the Elwynnese State, the Royal Instructing Justice of Elwynn shall be His Riverine Majesty's Advocate.

2. The Royal Instructing Justice of Elwynn shall also be His Riverine Majesty's Advocate in process known as prosecution when presenting the case against a malefactor or offender to a superior court.

Section 3: Royal Magistrates
In addition to the Royal Instructing Justice of Elwynn, the Court of Star Chamber shall also be composed of Royal Magistrates. The Royal Instructing Justice and the Royal Magistrates shall be appointed and removed by the King in Council. Any of the aforesaid judicial officials shall also cease to hold office upon zir death or resignation from zir office.

Section 4: Seats of Royal Magistrates
Each of the several Royal Magistries in the Court of Star Chamber – to which, for the purposes of the simulation, both persons and characters may be appointed to - shall correspond with a Royal Precinct or a Circuit.

Section 5: Powers of the Court of Star Chamber
The Court of Star Chamber shall properly oversee the administration of judicial investigations undertaken in relation to:
  • indictable offences under the Law of the Lands of the Two Sacred Rivers;
  • persons made subject to summary arrest in accordance with the Law of the Flower of the North;
  • conduct which would warrant the issuance of a Decree of Ardashirshahr-on-Storälven;
  • violations of the King's Peace;
  • preventative detention in accordance with the Law of the Jewel of Many Facets;
  • such other matters as would be tried by the Court of the King’s Bench sitting as a Court of Justiciary.
Section 6: Additional Powers
Additional powers pertaining to the Court of Star Chamber shall include:
  • the right to censure individuals on the occasion of their activities being sufficiently impious as to be contrary to the values of Societal Harmony and the pluralism and liberty that is the common right of all mankind and the best reflection of the Grace of the Divinity of the Lady Elwynn Herself;
  • the detention of lunatics and malefactors;
  • the furnishing of novel exotics and curiosities for the pleasure of His Riverine Majesty;
  • the validation of Summary Arrests and Preventative Detention Orders made under Elwynnese Law.
Section 7: Acts of Adjournal
The Court of Star Chamber may by Act of Adjournal lay down rules and regulations on its procedure as well as of that of the Commandery Courts and the Arches Courts that are not covered by Royal Law.

Chapter 5: Final provisions

Section 1: Citation
This Act may be cited as the Organization of the Union Act 1640.

Section 2: Superseding

This Act supersedes and complements existing law on Bailiwicks, Royal Precincts and the Courts of Law.

Section 3: Enactment
This Act enters force upon Royal Assent.

Section 2: Agnesia and Wintergleam

2.1 The County of Agnesia and Wintergleam is divided into two Circuits, the Circuit of Agnesia and the Circuit of Wintergleam

2.2 The Circuit of Agnesia consists of the following bailiwicks

Section 1: Scope

This bill shall apply to the Royal Precinct of Alalehzamin and Utasia.

Section 2: Amendment

2.1. Section 3 of the 'Act to divide certain Royal Precincts into Circuits' shall be amended to read as shown at Schedule 1 to this bill.

Section 3

3.1 This Act may be cited as the Circuit (Morskeep) Amendment Act.

3.2 This Act enters into force upon receipt of Royal Assent.

BE IT ENACTED by the King’s most Excellent Majesty, by and with the advice and consent of His Councillors of Eliria, acting as Sænators of the Union, and the Representatives of the Elwynnese Nation, in the present Royal Parliament assembled, and by the authority of the same, as follows:

A Bill to provide for organization of the Union after the Mishalan–Morskeep land trade

Section 1
