ÊRA ÂLÔON RIQI AURA ELLION


When Elwynn walked the land, the darkest storm
Would dissipate into a welcome breeze
When in Araxion she dwelt or slept
All spite would fly, and every fear release
When Demoreth, or Demoran drew near
Their faces paled; their legs would turn and flee.

All vengeance, hatred, and debate would turn
To friendship, love, and unanimity.


Article 1
THE ELWYNNESE NATION


§1. Self-determination


I. The Elwynnese Nation (Etâq Ellion) affirms its sovereign and historic right to self-determination to be one inalienable right that cannot be negotiated away.

II. Sovereignty is vested in the Elwynnese Nation and in the Elwynnese Nation alone.

§2. Elwynnese Nation


Each and every such man, woman or child sharing affinity or bonds of blood, friendship or law, with the Elwynnese Nation, the Lands of the River Elwynn (Adur Lum Ellion), or with the values of Elwynn, has the divine right of and claim to membership in the Elwynnese Nation.

§3. Hopes


The hopes of the Elwynnese Nation focus on Peace between all Brothers, between all Sisters and between all Children of Eiseamlair wherever they may be, particular within their own divided Nation. The Elwynnese Nation will forever strive for uniting their People under a rule of peace, sovereignty and self-determination.

Article 2
THE FREE STATE


§1. Succession


I. The Elwynn Free State, as established in 1104 as the sovereign entity of the Elwynnese Nation and Peoples, remains the sovereign gathering of the Nation exercising the Elwynnese Nation's rights, freedoms and obligations.

II. The Elwynn Free State acquiesed to the rule of the Duchy of Elwynn, Raynor's feudal lordship established in 577 that subjugated the Lands of the River, as long as it was deemed to be in the interest of the prosperity and harmony of all.

III. Following the culmination of long standing trends which have been part of a greater design to eradicate the Elwynnese nationhood, its characteristics and its institutions of government, the Elwynnese government, declared, on behalf the Nation, the Elwynnese State sovereign, free, and independent.

IV. The Laws of Elwynn, being a mixture of the conventions of the Free State, the Decrees of the Duke and the Acts of Council and of Congress remain standing insofar they do not conflict with this Êra Alôon (Charter of Government) and to any such laws that this Êra Alôon authorizes.

§2. Three Branches of Government


In the Free State, there are three branches or powers of government, viz. the legislative, the executive and the adjudicative.

Article 3
THE LEGISLATIVE POWERS


§1. Congress


The legislative powers of the Free State are vested in a unicameral legislature bearing the name of Congress of Elwynn (Anceoman)

§2. Lawmaking


I. Congress makes passes legal acts for all such matters not delegated to any authority or institution under this Êra Âlôon.

II. Congress passes resolutions that either express the opinion of Congress on a matter (non-binding resolution) or that instruct an official of the Free State in the direction Congress wills.

§3. Elections


Congress elects and recalls the Steward in a manner prescribed by Congress.

§4. Membership


Every member of the Elwynnese Nation has the right of both voice and vote in Congress.

§5. Sessions


Congress meets in public sessions whenever expedient. Between sessions, the day-to-day affairs of the Free State are governed by the executive.

§6. Internal rules


Congress shall determine its own rules of order and of presidency.

Article 4
THE EXECUTIVE POWERS


§1. Steward


The Steward (Raes) holds the executive powers of the Free State and exercises them in accordance with law. The Steward answers to Congress.

§2. Counties


I. The Steward names the governors of the counties under the jurisdiction of Free State.

II. The governor administers the county he is responsible of in accordance with law. He or she holds the office of governor during good behaviour but may at any time be removed from office by a resolution of Congress or by an order of the Steward.

III. The counties of Elwynn under the jurisdiction of the Free State are Alalehzamin, Araxion, Cape Farewell, Eliria and Utasia, and Iserdia.

§3. Council at Eliria


I. The Steward and the governors of the counties meet regularly in the Council at Eliria (Bar Elîrion).

II. The Council at Eliria is tasked with advising the Steward on matters arising in the Free State. Its meetings are public.

III. The Order of Seniority of the Council at Eliria is based on the dates of establishment of the counties, and is as follows:
  • 1. The Steward
    2. The Governor of Alalehzamin (2259)
    3. The Governor of Araxion (2282)
    4. The Governor of Eliria and Utasia (2282)
    5. The Governor of Iserdia (2282)
    6. The Governor of Cape Farewell (3300)
IV. The Steward shall assign the first person following him or her in the Order of Seniority to act in the Steward's stead when he or she shall be absent, provided that the first person following the Steward in the Order of Seniority is willing and capable of performing the duties of government.

Article 5
ADJUDICATIVE POWERS


§1. Judex


The adjudicative powers of the Free State, exercised in accordance with this Êra Âlôon, are in matters of crime and private dispute vested in the Judex (Iûdex), headed by an Arbiter of the Judex. The Judex is the court of first instance in the Free State.

§2. Arbiter of the Judex


I. The Arbiter of the Judex (Exuêr Iûdex), when acting under Art. 5 §1 presides over trials and arbitrations in the Judex, renders judgement on trials, and certifies settlements or awards in cases of arbitration in accordance with the legal procedure of the Land. A judgment or award, but not a settlement, may be appealed to the Supreme Court.

II. The Arbiter of the Judex attests oaths and contracts made in the Free State.

III. Until an Arbiter of the Judex is appointed by the Steward, the Steward shall assume the office of acting Arbiter of the Judex.

§3. Disputes with the Free State


Whenever a legal dispute in which the Free State is a party can only be settled by the recourse to the learned in law, the Supreme Court shall hear the case.

§4. Claims against the Êra Âlôon


I. Whenever a legal dispute involving this Êra Âlôon and the implementation and interpretation of its provisions, the Supreme Court shall, unless subsection II of this section applies, have jurisdiction

II. In a trial or process of arbitration in the Judex touches on matters involving opposing views on the interpretation of this Êra Âlôon, the Judex shall request the Supreme Court to interpret the relevant provisions. The opinion of the Supreme Court will be binding upon the Judex.

Article 6
RELATIONS WITH AMOKOLIA, HURMU AND THE UNION


§1. Confirmation of the Consensus


I. The Free State confirms that the Consensus of the Elwynnese, the Amokolians and the Hurmudans, established in Eliria in 4385, forms part of the body of constitutional law to which the Free State ascribes.

II. The Free State confirms the union with Amokolia and Hurmu, establishing the Riqi Adurellion ("Union") and shall act accordingly.

§2. Relations with Amokolia and Hurmu


The Free State gives full faith and credit to all legislative and judicial measures and acts in Amokolia and in Hurmu as well as Amokolian and Hurmu records and proceedings.

§3. Relations with the Union institutions


The Free State gives full faith and credit to all legislative and executive measures and acts on the Union level, as well as Union-level records and proceedings.

§4. Relations with the Union judicature


I. The Free State shall fully cooperate with the judicature of the Union, as established in the fifth chapter of the Consensus of 4385, and shall give effect to its judgements and orders.

II. The Free State shall fully cooperate with the Common Court of the Micras Treaty Organization in all cases arising under the Conventions and Treaties governing it and the ratifications of the Union of them.

III. Any mention of the Supreme Court in this Êra Âlôon shall be interpreted to be the Supreme Court of Elwynn, Amokolia and Hurmu.

Article 7
FINAL PROVISIONS


§1. Amendments


Congress may at any time pass amendments to this Êra Âlôon, provided that either (a) through a majority vote of Congress and the approval of the Senate of Elwynn, Amokolia and Hurmu, or (b) a vote of three quarters' majority in Congress.

§2. Entry into force


The Êra Âlôon enters force upon the ratification of Congress in the same manner that amendments may be made.
