PREAMBLE

Promulgated on Ermure 10, Qinamu 1605 by His Serenity Dâniyal Umra Suleiman Simrâni-Kâlirion ibn al-Majeed bin Sathrati, Conducător of Elwynn, Minister for Peace and Kinetics, Warden of the Northern March and Observer of the Shining Gardens of Kai-Raikoth & the Senator and Keeper of Greater Eliria at the Khan Bastion, Eliria Castle in the Bailiwick of Eliria


From [1605/IV] An Instrument of Government for the Passing of Certain Acts into Law and the Promulgation of the Charter of Coordination

(1) The aforementioned Acts cited in Article One will by this Instrument of Government be promulgated and published as a combined body of law for the edification and improvement of the Common Weal.
a. The Combined Acts are known as the Charter of Coordination.
(2) The Provincial Reform & Security Act (Coordination I) forms Chapter One and Two of the Charter of Coordination.
(3) The Rights of the Natural Person Act (Coordination II) forms Chapter Three of the Charter of Coordination.
(4) The President of the Senate is by this Instrument of Government formally empowered to review all extant laws and instruments of government of the State of Elwynn and its predecessor states and to codify appropriate texts derived thereof into subsequent Chapters of the Charter of Coordination, appropriately organised for convenient reference.
(5) The Charter of Coordination has primacy over all other Acts, Statutes and Regulations of the State of Elwynn with the exception of the Constitution which is the holiest of holies and shall henceforth be preserved in the inner sanctuary of the Court of the Prince where it may not be sullied nor polluted by human sight, human touch or human interpretation.
a. The inner sanctum is known as the Oracle of Liberty.
b. A Priest of Truth and Beauty will be appointed from the Household of the Steward of Elwynn. Only he who is ritually cleansed and who is humble before the Goddess may enter the Oracle of Liberty and look upon the Constitution.
i. The Priest of Truth and Beauty is called the Augur of Democracy.
c. The Senate may, with the permission of the Court of the Prince, address questions concerning the correct interpretation of the Constitution to the Augur of Democracy who may deign to read the Constitution, if the omens are auspicious.
i. The Senate must with any question offer up a suitable gift of one Talent (58.9 kilograms) of Gold per question for the benefit of the Goddess.
ii. Gold must be 24-carat lest the spirit of democracy be offended by timorous parsimony.
iii. The Augur of Democracy may, at his sole discretion, relay his answer to the Senate whether in person or in writing or any other appropriate medium. iv. The Augur of Democracy may edit or omit any portion of the answer as may be deemed appropriate in the service of the greater Truth of Elwynnese Liberty wherein the higher forms of Truth and Beauty are manifested and actuated.
v. The Senate must obey the answers of the Augur of Democracy as a Holy Writ bestowed by the mercies of the Goddess. The answers of the Augur must be stamped with the month and year they were received and must be collected and collated into Gospels which will be numbered and named after the reigning Sovereign and the Serving Augur in that period, for example "The Gospel of Simrâni-Kâlirion & Lysander".
d. It shall be a blasphemy to display the Constitution in public.
i. Icon paintings depicting a book covered by a shroud delivered by the Goddess Elwynn to a grateful nation will be commissioned and installed in public places.
ii. Icon paintings of the Shrouded Constitution may be worshipped and venerated by the general public in accordance with their religious freedoms.
e. Burnt offerings of a camel, an oxen, a goat and a lamb must be made every day of the year outside the Oracle of Liberty so as to propriate the Goddess and honour the Constitution.
1. The Augur of Democracy is permitted to establish a Priesthood to conduct and regulate the Sacrifice.
f. The Statue of Multiculturalism is declared a holy site in the custody of the Augur of Democracy and his Priesthood.
(6) Copies of the Charter of Coordination will be made and distributed to all households, workplaces, academic establishments and places of worship.
(7) The expression of disdain, doubt or irreverence is an offence whereby the transgressor gives cause to the State Authority to believe they that pose, in conceivably conducive circumstances, an imminent risk to both themselves and others as cited in Article 3(1)a,b,f,g&h of the Suppression of Deviancy Act.
i. Any person thus identified is to be made subject to a Preventative Detention Order and rendered unto the Court of Star Chamber for evaluation.

CHAPTER ONE: THE COUNTIES & BAILIWICKS OF ELWYNN

Section 1: Repeal
§1.1. The Act on the Administration of the Counties (11DA) is repealed.

Section 2: The Ceremonial Counties and the Marches
§2.1.1 The Ceremonial Counties of Elwynn are Alalehzamin, Araxion, Cape Farewell, Eliria and Utasia, Iserdia, Agnesia, Cimmeria and Wintergleam. Their borders are determined by the Court of the Prince.
§2.1.2. The Ceremonial Counties are collectively known as Elwynn Proper.
§2.1.3. Ceremonial Counties exist purely for cultural and historical purposes.
§2.1.4. Lord Lieutenants for the Ceremonial Counties of Elwynn may be appointed by the Court of the Prince, and only be appointed as a mark of individual favour. No powers shall be associated with those offices where they are created.
§2.2.1 Land outside Elwynn Proper are collectively known as the Marches.
§2.2.2. The Marches are divided in three; the Northern Marches, the Western Marches and the Eastern Marches.

Section 3: The Bailiwicks (Circles)
§3.1. Bailiwicks exist for purposes of statistics, law and and taxation. Bailiwicks cover all of Elwynn.
§3.2. Acts of Senate ratify and effect the changes to the names, borders and numbers of the Bailiwicks.
§3.3. The Bailiwicks under this Act are those listed on Schedule I.
§3.4. Bailiwicks in the Marches are governed by martial law until such time that peace, order and good government can be restored.

Section 4: Governor
§4.1. The Governor is be chosen by means of an acclamation and general Clamour brought forth by the Consultative Shura after the conduct of a Muster under Arms.
§4.1.1. The Court of the Prince must be notified of the outcome of the Clamour of the Shura by means of a humble petition, submitted in person by the delegates of the Consultative Shura from amongst the Muster under Arms undertaking a Pilgrimage of Grace to Eliria, requesting Letters Patent of confirmation from the Court of the Prince.
§4.2. The Governor shall have as his duties:
§4.2.1. The performance of such tasks and obligations as shall befall the executive office-holder of the Bailiwick as a consequence of Union Law;
§4.2.2. The performance of such tasks and obligations as shall befall the executive office-holder of the Bailiwick as a consequence of this Act.
§4.2.3. The issuance of writs pertaining to the undertaking of the aforesaid duties and the maintaining of proper records concerning the same.
§4.3. The Governor must select the one hundred eminent persons of his Bailiwick who will form his Consultative Shura who will advise him on all matters and select his successor upon the occasion of his demise.

Section 5: Social Contract
§5.1. It shall be the duty of the Bailiwick to provide
§5.1.1. An excellent administration;
§5.1.2. A well-ordered public policy;
§5.1.3. Care for Subject Nationals;
§5.1.4. The means for Individual and Collective Prosperity for the Improvement of the Common-Weal of the whole Bailiwick;
§5.1.5. Impartial and Unyielding Justice;
§5.1.6. Security in the Defence of the Person and Property of all lawful Subject Nationals
§5.2. It is the obligation of the Subject Nationals to;
§5.2.1. Owe deference and obedience to lawful authority;
§5.2.2. To Uphold the Union Law and Defend the State.
§5.3. It is the right of Subject Nationals to enjoy:
§5.3.1. Life, liberty and the pursuit of happiness, to the extent permissible under law;
§5.3.2. The a fair hearing under law and the right of Habeas Corpus.

Section 6: Services of the Bailiwick
§6.1. The Duties of the Bailiwicks shall include:
§6.1.1. The regulation of its own commerce, the minting of coin (for local trade – supplementary to Florins), the appointment of magistrates, the collecting of dues, voting grants of nominal monies to the Governor and the State of Elwynn, the building of roads, the laying of sewers, the keeping of streets and waterways free from befoulment, the schooling of minors in a manner useful to trade, industry and commerce;
§6.1.2. The regulation of the Guilds of Dunporters, Artisans, Artificers, Factors, Aldermen and others as may be provided for under law or by writ or charter.

Section 7: Municipal Corporations
§7.1. In each Bailiwick is a ‘Worshipful Municipal Corporation of Dunporters, Artisans, Artificers, Factors and Aldermen of the Bailiwick of [Insert Name], Guarantors of its Ancient Liberties’, which may be known as the Corporation of [Insert Name] for short.
§7.2. Each of these ranks represents a distinct guild within the Corporation:
§7.2.1. The Guild of Dunporters represents the cleaners, the diggers and the toilers who remove the nightsoil of our Common Weal. They are also responsible for the spreading of the nightsoil in the fields and for this reason we count the constituency of yeoman-farmers and country folk amongst them.
§7.2.2. The Guild of Artisans comprises the craftsmen responsible for the manufacture of the products necessary for the functioning of our society and trade.
§7.2.3. The Guild of Artificers are those craftsmen of exceeding quality and skill whose hand has turned to the creation of luxury goods, adding value to the products of the artisans for the benefit of the export market.
§7.2.4. The Guild of Factors is the home of all merchants charged with the export of finished goods and the import of raw materials for those finished goods where insufficient quantities are available at home as well as nominal monies for those finished goods.
§7.2.5. The Guild of Aldermen, comprises the one-hundred and fifty most able individuals in each Bailiwick.
§7.2.5.1. An able individual is defined as one who:
§7.2.5.1.1. Has, after his or her twentieth birthday, passed the competitive examination for entry into the Guild;
§7.2.5.1.2. Is possessed of the highest Intelligence Quotient (Fluid intelligence, Crystallized intelligence, Quantitative reasoning, Reading and writing ability, Short-term memory, Long-term storage and retrieval, Visual processing, Auditory processing, Processing speed & Decision-making capacity) for the Bailiwick, as confirmed by Guild Examination;
§7.2.5.1.3. Is capable of performing the Command Fitness Test once a year and passing as confirmed by Guild Examination;
§7.2.5.1.4. Is of sound body and mind with no genetic defects or abnormalities;
§7.2.5.1.5. Has been made subject to Guild Examination and is proven to be fertile.
§7.2.5.2. The One-Hundred and Fifty Worthies in each Bailiwick are chosen from the lists of the eligible 'able individuals' as identified by Guild Examination.
§7.2.5.2.1. Where the number of able individuals exceeds the number of vacancies in a Bailiwick the surplus will be graded according to their ability and offered free transfer to another Bailiwick where a vacancy exists in the Guild Chapter.
§7.2.5.3. In each Bailiwick the Chapter of the Guild of Aldermen is pledged to the public good and must undertake the acts of charity, maintenance, defence, and command that are necessary for the good of the common-weal and to uphold the Social Contract (Section 5 of Chapter One).
§7.2.5.4. Provision will be made by the Court of the Prince to each Chapter of the Guild of Aldermen that is commensurate to the service they render.
§7.2.5.5. Senators of the Senate of Elwynn are, by virtue of the estimation of the Court of the Prince, enrolled into the Eliria Chapter of the Guild of Aldermen irrespective of their capacity to meet the criteria for membership (C1.§7.2.5.1.).
§7.2.6. Each guild is self-regulating at the discretion of its members and may promulgate a charter. For a charter to be valid it must receive the assent of the Court of the Prince.

CHAPTER TWO: STATE SECURITY

Section 1: Gentlemen-at-Cudgels:
§1.1. There shall be established within the bounds of the State of Elwynn a force for the maintenance of order and discipline therein. This force shall be known as the Gentlemen-at-Cudgels, an Auxiliary Corps of the Union Defence Force, collectively, and individually by titles graded according to rank, area of command and proficiency, as shall be set out hereafter.

Section 2: Structure:
§2.1. The Gentlemen-at-Cudgels shall consist of a graded structure as intimated by Article Eight;
§2.2. At its apex shall be the Bludgeoner-General, who shall act at the behest of the Court of the Prince and in that manner shall operate an effective command over all subordinate gentlemen-at-cudgels whom he shall appoint in the State of Elwynn for public service with cudgels in the manner instructed by higher authority;
§2.3. Appointed by the Bludgeoner-General shall be a Superintendent Officer of Cudgels for each of March of this State. The Superintendent Officer of Cudgels shall have primary responsibility for the conduct of cudgelling in the March under his charge and shall answer to the Bludgeoner-General for the same;
§2.4. In each city Bailiwick of the March the Superintendent Officer of Cudgels shall appoint a Master of Cudgels who shall be charged with the expediting of writs of cudgelling and other similarly civic-minded duties. The Master of Cudgels shall answer to the Superintendent Officer of Cudgels for his conduct in the exercise of his duties. The Master of Cudgels shall have the services of a retinue of twenty Gentleman-Cudgellers and as many cudgel-carriers and apprentice cudgel-carriers shall be deemed appropriate;
§2.5. The Court of the Prince may at its own discretion establish ad hoc Commanderies or fortified outposts within the State under the civilian authority of a Reeve assisted by a Gentleman-Cudgeller, who shall answer to the Superintendent Officer of Cudgels in the March where the Commandery is established. The Gentleman-Cudgeller shall have command of twenty cudgel-carriers, being the lowest rank of non-apprenticed cudgellers.

Section 3: Writ of Cudgelling
§3.1. A writ of cudgelling may be issued by the Court of the Prince for any act that may be reasonably accomplished through the application of cudgels provided that it is discernibly for the benefit of public order and discipline and is to the commonweal of the greater portion of the denizens resident in the State of Elwynn;
§3.2. The writ shall specify which Bailiwick or Commandery shall be responsible for the cudgelling, what or whom the cudgelling is to be against, and what is to be done with the cudgelled subsequent to the act of cudgelling;
§3.3. To be valid the writ must be signed by the Court of the Prince and the cudgelling thoroughly expedited by no later than twelve days after the issuance of the aforementioned writ;
§3.4. A writ of cudgelling shall not be considered to be lawfully applicable outside the bounds of the Court of the Princey and authorisation to pursue miscreants and fugitives for the purpose of cudgelling must be sought firstly from the Duke where they are known to have fled and be at large in Elwynn or from the Kaiser if they have fled elsewhere;
§3.5. The Councillors of Eliria shall enjoy immunity from cudgelling, this privilege not necessarily being extended to their retainers, avatars, alter-egos &c. subject to the discretion of the Court of the Prince.

Section 4: The Panopticon Department
§4.1. By this order the Panopticon Department is hereby constituted.
§4.2. It shall be administered and directed by the Panopticon Department Main Office which shall itself be under the direction of the Chief Director who shall be appointed by the Court of the Prince.
§4.3. The Panopticon Department shall combat all enemies of the State within and outside the borders of the State.

Section 5: Panopticon Department Main Office
§5.1. The Panopticon Department Main Office shall have responsibility for the coordination of all departments of the security apparatus within the Panopticon Department.

Section 6: The Panopticon Structure
§6.1. The Panopticon Department shall be structured as follows:
§6.1.1. Office A: Internal Security
§6.1.2. Office B: Criminal Activities
§6.1.3. Office C: Counter Intelligence
§6.1.4. Office D: Identity, Moral Rearmament & Enlightenment of Elwdom
§6.2. Under those offices the Chief Director Panopticon Department (Main Office) may raise any ad hoc units and formations as he may deem appropriate for the fulfilment of the remit of the Panopticon Department as set out in C2.§4.3.

Section 7: Enabling Powers
§7.1. The Chief Director Panopticon Department (Main Office) is authorised to undertake whatever actions he deems appropriate for the security of the County and shall be granted immunity from prosecution for any actions undertaken in accordance with his role, subject to the discretion of the Court of the Prince.

Section 8: Elwynns Riddare
§8.1. There shall established a force of five hundred men at arms for the protection of the person of the Steward of Elwynn and such other tasks as the Steward may see fit to direct them to undertake, including the maintenance of the Personregister.
§8.2. This force shall be known as the Elwynns Riddare (Knights of Elwynn).
§8.3. Each Riddaren shall receive the rank of Legate and receive a Legatine Commission to execute the will of the Steward in the State of Elwynn.
§8.4. The Master (Riddare-Kommandant) of the Elwynns Riddare, to whom all Legates must account themselves, is the creation of the Steward.
§8.5. A Ribat (Chapter House) of the Riddare shall be established in each Bailiwick of the State of Elwynn.
§8.6. The Elwynns Riddare shall be subject to such rules as shall be promulgated by the State and the Riddare-Kommandant.

CHAPTER THREE: RIGHTS OF THE NATURAL PERSON

Section 1: The Natural Person
§1.1. A person or persons is, when cited in the Law, without exception a Human Being (Homo Sapiens) of independent agency whose actual existence has been attested and confirmed by the Court of the Prince upon the occasion of the grant of nationality rights (including specifically naturalisation). Such a person is a Natural Person entitled to full civic and human rights under law.
§1.1.1. For the purpose of this Act Elfinshi shall be considered Homo Sapiens.
§1.2. A Natural Person is possessed of the qualities of Humanity and the dignity inherent in the Human Condition.
§1.3. Where attestation has not been made or is proven to be false upon investigation by the Court of the Prince, the State Security Apparatus or other lawful agents of the state as may be appointed (the Authorities), the party that has either declined to attest, falsely sworn or else denied their Humanity shall have repudiated their right to be considered a Natural Person under Law.
§1.4. Only an attested Natural Person may hold public office in the State of Elwynn.
§1.5. Nothing in this Act nor in law shall prevent or constrain the Natural Person from possessing and maintaining auxiliary personalities, personae, servitors or avatars save that these shall be notified to the Authorities and their particulars held in a register maintained by the Court of the Prince.
§1.5.1. Auxiliary personalities shall be deemed appendages to the Natural Person.
§1.5.2. Auxiliary personalities depicting entities other than a Person shall not attract penalties save that they may not be used to hold public office in the stead of the Natural Person who they are the appendage of.

Section 2: Unnatural Persons
§2.1. An Unnatural Person is an entity that has entered into correspondence with the State of Elwynn and, having applied for naturalisation, failed to provide an attestation to the satisfaction of the Authorities.
§2.2. The existence of an Unnatural Person is aberrant and must be rectified by the Authorities through the application of reason and the Rule of Law.
§2.3. To deny ones own Humanity is an offence. It shall carry the penalty of exclusion from the physical space, forums and internet presence of the State of Elwynn for a period of one month. Repeat offences shall in the forfeiture of Elwynnese Nationality.

Section 3: Categorisation as an Entity Other than the Person (Natural or Unnatural)
§3.1. On application to the Court of Star Chamber the Authorities may petition for the categorisation of the entity in a form other than the Person. These alternatives include:
§3.1.1. Animal;
§3.1.2. Corporate;
§3.1.3. Alien.
§3.2. An entity defined as Animal is confirmed in the right to life and the reasonable expectation of freedom from cruel usage, except where the needs of a Natural Person for survival or nourishment permits killing or cruel treatment, provided that the cruelty is minimised.
§3.3. A Corporate entity is formed by a business corporation or other appropriate organisation – its rights and responsibilities shall be defined separately under law. A Corporate entity is not entitled to civic rights accorded to a Natural Person.
§3.4. An Alien is an entity of non-Human and or extraterrestrial origin. Although sentient it is not possessed of the Human Condition and cannot be considered a Natural Person under law. It is an offence to treat an Alien as a Natural Person which shall carry the penalty of a Five Hundred Florin fine to the offending party.
§3.4.1. Aliens are fundamentally injurious to the health and well being of Natural Persons. Any Alien encountered entering the territory of the State of Elwynn is forfeit to the Court of the Prince and is to be Quarantined by the Authorities.

Section 4: Habeas Corpus
§4.1. The Writ Habeas corpus ad subiciendum when served by a competent authority must be observed and adhered to by all parties in receipt of it when within the boundaries of the Elwynnese Union.
§4.2. That whensoever any person or persons shall bring any habeas corpus directed unto any sheriff or sheriffs, gaoler, cudgeller or other person whatsoever, for any person in his or their custody, and the said writ shall be served upon the said officer, or left at the gaol or prison with any of the under-officers, under-keepers or deputy of the said officers or keepers, that the said officer or officers, his or their under-officers, under-keepers or deputies, shall within three days after the service thereof as aforesaid (unless the commitment aforesaid were for treason or felony, plainly and specially expressed in the warrant of commitment) upon payment or tender of the charges of bringing the said prisoner, to be ascertained by the judge or court that awarded the same, and endorsed upon the said writ and upon security given by his own bond to pay the charges of carrying back the prisoner, if he shall be remanded by the court or judge to which he shall be brought according to the true intent of this present act, and that he will not make any escape by the way, make return of such writ;
§4.2.1 and bring or cause to be brought the body of the party so committed or restrained, unto or before the Count for the time being, or the judges of the said court from which the said writ shall issue, or unto and before such other person or persons before whom the said writ is made returnable, according to the command thereof;
§4.2.2. and shall then likewise certify the true causes of his detainer or imprisonment.

Section 5: Repeals
5.1. Articles 1 to 3 of 'Decree LX - Minority Rights and Corporal Punishment' are repealed.


CHAPTER FOUR: JUSTICE

Section 1: The Court of Star Chamber
§1.1. There shall be created within the Council of Eliria the subordinate court that shall be known as the Court of Star Chamber.
§1.2. This Court of Star Chamber shall properly oversee the administration of judicial investigations undertaken in relation to persons made subject to summary arrest or preventative detention in accordance with this Act.
§1.3. To that end the Court of Star Chamber shall be the seat of the Instructing Justice of the State of Elwynn who shall be His Serenity’s Advocate with regards to the persecution and punishment of the enemies of Democracy, and the process known as prosecution when presenting the case against a malefactor to a superior court or unto His Serenity.
§1.4. Additional powers pertaining to the Court of Star Chamber shall include the right to censure individuals on the occasion of their activities being sufficiently impious as to be contrary to the values of a Democratic Society, the detention of lunatics and malefactors, the furnishing of novel exotics and curiosities for the pleasure of His Serenity, and the validation of Summary Arrests and Preventative Detention Orders made under this Charter.


Section 2: Powers of Summary Arrest
§2.1. Powers of summary arrest are held by all officers, whether commissioned or non-commissioned, of the Union Defence Force, and any person or organisation granted powers of summary arrest as officers of the law by His Serenity’s Government.
§2.2. Sworn officers of Union Defence Force are granted powers of summary arrest in pursuit of suspected or known crime committed by any residentor Citizen of the State of Elwynn.
§2.3. Members of the Senate shall enjoy immunity from the powers of summary arrest outlined in this section except when special dispensation has been obtained by the Court of Star Chamber from His Serenity the Prince or the Steward, in which case powers of summary arrest may be exercised by the Instructing Justice of the Court of Star Chamber.

Section 3: Preventative Detention Order
§3.1. Any authorised public officer, as defined by custom and usage, shall be empowered to issue Preventative Detention Orders when they have sufficient grounds to justify, to the extent that they are satisfied, that a person or persons has the potential to pose, in conceivably conducive circumstances, an imminent risk to both themselves and others by virtue of meeting any one of the following criteria:
§3.1.1. Displays of emotional incontinence, indicative of disharmonious influences, including:
§3.1.1.1. Neurosis
§3.1.1.2. Pathological behaviours
§3.1.1.3. Lack of Moral Fibre
§3.1.2. Mental or physical retardation;
§3.1.3. Conscientious Objection to the orders of lawfully appointed officers of His Serenity's Government;
§3.1.4. The setting of fire or explosives for heretical purposes, contrary to those of the favoured true religions of Elwynn;
§3.1.5. Vagrancy;
§3.1.6. Failure to adhere diligently to expected social norms;
§3.1.7. Suspicious and unbecoming conduct;
§3.1.8. The outrage of public decency
§3.2. A Preventative Detention Order may be executed by any officer to whom powers of summary arrest have been delegated as per Section 2 of Chapter Four of this Charter.

CHAPTER FIVE: COURT OF THE PRINCE

Section 1: The Mandate of the Prince
§1.1. The executive powers of the Coordinated State are entrusted to the Prince who exercises them with advice of his Councillors.
§1.2. The Prince has the power of decree in matters of military affairs, economic coordination, resource allocation, Imperial affairs, communications, census and statistics, immigration, border security, energy, asylum, naturalization of foreigners, Quarantine, Public Health, Education, or in other mandate assigned to him by the Senate.
§1.2.1. These powers can be delegated by the Prince to departments and must be so delegated before planned periods of leave if no Steward has been appointed.
§1.2.2. These powers include the power of appointment to any affected ministry, department or office of the Court of the Prince, the Union Defence Force and the Marches.
§1.2.3. The exercise of these powers must take the form of an Instrument of Government.
§1.3. Every three months the Prince shall enumerate the total number of nationals and residents in the Coordinated State and shall record their names and places of domicile. The Court of the Prince may also record other statistics as it deems necessary. No one shall be compelled to provide information of the latter kind.

Section 2: The Council of Eliria
§2.1. The Prince has the power to appoint Councillors to the Council of Eliria. The Councillors serve as policy advisers.
§2.2. The Prince must follow the advise of the Majority of His Councillors with regards to Instruments of Government concerning appointments and the enactment of decrees.

Section 3: The Cabal of Government
§3.1. The Prince has the power to appoint Magisters to exercise delegated powers from amongst those listed (C5.§1.2.)
§3.2. Magisters have the power to manage their own departments, create their own sub-departments, and appoint their own staff as required. When the Magisters act in the Prince's name, they do so as the Court of the Prince.

Section 4: The Election of the Prince
§4.1. The Prince must be elected by the Senate by a plurality vote of the Senators present during a 96-hour period. Should there be a tie, the President of the Senate shall have the casting vote.
§4.2. The Prince shall assume office by taking the solemn affirmation of office in the presence of the Senate: I, NN, having been elected Prince of Elwynn, solemnly affirm and promise that I shall render dutiful worship to the Shrouded Constitution and be faithful to the Elwynnese Nation and the Charter of Coordination. I shall at all times do nothing that to me shall seem to be injurious to the People of Elwynn, their rights and freedoms, and the Charter.

Section 5: The Term of Office for the Prince
§5.1. The term of office of the Prince shall be no longer than three calendar months. Unless by ancestral right Patron of the House of Kalir, no Prince may hold office for two consecutive terms.
§5.2. The Prince shall be deemed to have been removed from the office upon death, resignation from office, removal from office by the Senate or failure to assume office within three days from election.
§5.3. The Prince may be removed from office by the Senate, following the passage of a motion of impeachment. Impeachment requires a two-thirds (2/3) majority in the Senate.
§5.4. If no Steward is appointed, and the Prince is on announced leave of absence or has been unaccounted for for ten days, the Senate has the authority to elect one.

CHAPTER SIX: ARMED FORCES

Section 1: Authorization
§1.1. The Senate authorizes the Prince to raise, equip and maintain armed forces for the defence of Elwynn and the promotion of peace.
§1.2. The armed forces shall be known by the name of the Union Defence Force.
§1.3. The Senate invests in the Prince the full powers pertaining to a Commander-in-Chief. The Prince may delegate these powers to the Generalissimo of the Union Defence Force.
§1.4. It shall be the duty and the right of the Prince to take care that, throughout the Union Defence Force, all units and formations be kept full and well equipped, and that unity be established and maintained in regard to organisation and formation, equipment, and command in the training of the men, as well as in the qualification of the officers. For these purpose the Prince shall be authorised to satisfy himself at any time of the condition of the several contingents, and to provide remedies for existing defects.
§1.5. The Prince shall determine the strength, composition, and division of the contingents of the Union Defence Force, and also the organisation of the militia, and he shall have the right to designate garrisons within the territory of the State, as also to call any portion of the Union Defence into active service, subject to limitations detailed by the Charter herein.

Section 2: Recruitment
§2.1. Every Citizen is subject to military duty, and in the discharge of this duty as a Soldier no substitute can be accepted.
§2.2. A Soldier has his residence in his garrison. The residence of a soldier who has no garrison within the country is deemed to be his last garrison within the country.
§2.3. A Soldier resides apart from civil society, and during his Tenure of Service all guild, corporate and familial affiliations are held to be in abeyance. A Soldier has one loyalty - to the State.
§2.3.1. At the end of his Tenure of Service the Soldier shall return to his former affiliations and obligations as a Citizen of Civil Society.
§2.3.2. The former Soldier, returning to Civil Society as a Citizen may, unless subject to a criminal record, be considered for preferential advancement, promotion or transfer, between Guilds, Corporations and Bailiwicks, based upon his record of service and demonstrable skills acquired.
§2.4. Every Citizen capable of bearing arms shall be available to serve for seven years in the Union Defence Force, ordinarily from the end of his twentieth to the beginning of his twenty-eighth years; the first three in the Territorial Defence, the last four years in the Auxiliary Corps; during the next five years he shall belong to the Reserve which will provide the Non-Combat Service Corps.
§2.5. The strength of the Union Defence Force in time of peace shall be 1,835,504 soldiers, being 1 percent of the population of the Coordinated State as reported by the Census Bureau for the year 1608, and shall be furnished by the Bailiwicks in proportion to their population. Any adjustment to the strength of army in time of peace shall be fixed by legislation.

Section 3: Limitations
§3.1. The Senate reaffirms its constitutional right to declare war and authorise the deployment of armed forces abroad.
§3.2. The Prince may not declare war and can only deploy forces abroad prior to authorisation in the event of the State of Elwynn being significantly imperilled by an impending and or imminent attack for the purpose of safeguarding the Realm.
§3.3. In the event of authorising a unilateral deployment of forces, any such deployment must be referred by the Prince to the Senate within forty-eight (48) hours of the authorisation being given.
§3.4. The Senate may impeach the Prince if, by a majority vote, it feels he has acted without justifiable cause. The Offence shall be that of 'Usurpation of Authority and the Waging of Warfare Contrary to Law'. The Prince, if impeached, shall, in addition to suffering loss of Office, be prohibited from holding public office for thirty Elw Years and be referred to the Court of Star Chamber for investigation and trial.
§3.5. The costs and the burden of all the military system of the State are to be borne equally by all the Bailiwicks and their subjects, and no privileges or molestations of the Bailiwicks or Guilds are admissible. Where an equal distribution of the burdens cannot be effected in natura without prejudice to the public welfare, affairs shall be equalised by legislation in accordance with the principles of the Veiled Constitution as interpreted by the Augur of Democracy.

CHAPTER SEVEN: GUILD COMMUNISM AND STATE FINANCE

Section 1: Prohibition of Capitalism
§1.1. The acquisition of wealth is not a legitimate objective for Civil Society; the Coordinated-State works to better humanity.
§1.2. The Standardised Currency and Unified Economy Treaty (hereinafter "SCUE") Credit is not accepted for transactional purposes within the State of Elwynn.
Any entity possessing SCUE funds within the jurisdiction of the State is immediately defunded of all assets which are transferred to the Panopticon Corps.
§1.2.1. The importation of Currency and Promissory Notes is prohibited.
§1.3. The Law Reform Act of 1604 and the Economy Act are repealed.

Section 2: Allocations & Appropriations
§2.1. Resource Allocations (notionalised as 'social credits' known as Theoretical Florins) are made by the State, determined by the Court of the Prince and approved by the Senate. Disbursements of these allocations are then made to the Magisters for state expenditure and to the Wardens for allocation to the Bailiwicks of Elwynn Proper and the Marches.
§2.2. Allocations are made by the Wardens to the Governors of the Bailiwicks and to the Guild of Aldermen directly. Governors then make allocations to the four Civil Society Guilds (Dunporters, Artisans, Artificers & Factors).
§2.3. Appropriations in turn are made by the Governors taking from the Guilds and voting a contribution to the Wardens who surrender the surplus to the Court of the Prince. Magisters will also return any unallocated resource to the Court of the Prince at the end of each year.
§2.4. The overall assumption is that any individual or entity shall be entitled to sufficient resource in order to function optimally [Entitlement=Need/Capacity(to Contribute)*Utility].
§2.5. The Magister of the Hall of Allocations and Appropriations shall diligently assign a component value to the contributing factors that define in turn Need, Capacity & Utility for each variable factor in society.
§2.6. Self to Self credit transfers are permitted on an individual basis.
§2.7. Resource exchanges between Municipal Corporations, the State and other legally established entities shall be by the exchange of Bills of Transfer.
§2.7.1. The terms of which shall be established by a Memorandum of Understanding forming a Contract between the parties to the Trade.

Section 3: The Assertion of Right
§3.1. All Bullion, mineral resources, raw materials, natural resources of any form whatsoever, including wildlife, within all of the realm of the State of Elwynn, are by incontestable right under this Charter, the exclusive property of the People of Elwynn.
§3.1.1. In the name of the People that right is hereby asserted by the State of Elwynn.
§3.2. Excluding those items brought into the State from beyond the Continent of Benacia by whatever means, it shall be understood and accepted by all, that it shall only be by the most graciously permitted allowance of the Court of the Prince that any of the aforesaid articles covered by the Assertion of Right shall be extracted from the territory held under the jurisdiction of the State of Elwynn.
§3.3. Permits for the extraction of raw materials for the benefit of the People of Elwynn, must be sought through application to Court of the Prince.
§3.3.1. Licences for mineral extraction and export must be sought in triplicate from the Court of the Prince, the Senate of Elwynn and the Court of Star Chamber.
