The Imperial Minister of Military Affairs, the esteemed lady, Her Imperial Highness Liv Dravot al Osman, the Imperial Mother, has issued an edict forcing all careholders of male Vanic community servants to be euthanized. With 59,210,187 community servants in the Imperial Republic (Census 1656), of which the Ministry of the Interior estimate 90% are Vanic. Of the Vanic community servants, the Minstry estimates that one third are male (albeit castrated).
First of all – the forced euthanasia constitutes murder under the Criminal Code of Shireroth:
As such the edict constitutes an order to euthanize approximately 35 million men. This is a considerable amount of people. Even though community servants are the property of the Imperial Republic, many are under the effective ownership (as the care of a community servant is an asset) of the nobility of the Imperial Republic. A forced euthanasia of so many valuable assets – with the promise in the edict of just compensation, is an infringement of imperial law.CC 3.1 wrote:A person who, unless it is approved by an Act, does any act, or attempts to do any act, to cause the death or destruction of another natural person, shall be guilty of a crime, called Murder, and liable to the punishment of death.
Even if the edict justly compensates careholders of the affected community servants, imperial law has not been enacted to allow the funding of the compensation of the euthanasia of 35 million men. A just compensation should include the market value of the community servant in question (prior to the edict, of course) and costs for euthanasia and disposal of the remains. These are considerable expenses. A good, strong, healthy Vanic male community servant is expensive. Due to their culture, Vanic men are extremely loyal and submissive. Their genetics are therefore perfect for servitude. It is an outrage that such assets be taken away from us.
Under precedent, imperial law – either through decree or Landsraad enactment – allows for funds.
Accordingly, under the law of the Imperial Republic, any order to euthanize the male Vanic community servant must first be authorized by imperial law. The edict does not constitute imperial law, as it is secondary legislation.
As such, I hold the edict illegal, and I request that the Judex examines the legality of it. Further, I request that while the Judex examines the matter, it makes an injunction against the enforcement of the edict.
