[NK] Bill 002: Executive Accountability

The Honourable Members of the House of Deputies and the House of Representatives, attest and confirm this

Executive Accountability Act 002


WHEREAS the Confederate Constitution mandates a separation of powers between the Legislative and the Executive branches of government, and in order to ensure due process and accountability of the Executive branch, We do by this Act
  1. Grant unto the House of Deputies and the House of Representatives the right to scrutinise and hold to account the Executive branch;
  2. Grant unto the House of Deputies and the House of Representatives the right to request information, to subpoena individuals to testify before either House, and to issue such orders as may be necessary to compel and ensure the production of evidence that is requested;
  3. Grant unto the House of Deputies the right to impeach the Governor for illegal action or for disregard for the Confederate Constitution and the democratic process;
  4. Grant unto the House of Representatives the right to try the Governor for the reasons of impeachment, and convict the Governor subject to a two-thirds majority vote, in which case the Governor shall be removed from office with immediate effect;
  5. Grant unto the House of Deputies the right to appoint an Acting Governor in the event of conviction by the House of Representatives until a newly elected Governor is sworn into office;
  6. Grant unto the Governor the right to personal privacy, and the right to refuse to provide information that constitutes an intrusion to that right to personal privacy;
  7. Grant unto the Governor the right to appear before either House, or before a joint meeting of both Houses.

  3. The Executive branch may claim Executive Privilege as a response to requests of information by either House, in which case the Executive branch shall not be required to provide such information, but shall have the obligation to state the reasons for such action.
  4. Grant unto the House of Deputies the right to impeach the Governor for illegal action or for disregard for the Confederate Constitution and the democratic process;

Executive Privilege may be overridden by a two-thirds majority vote in both Houses;
  4. Grant unto the House of Deputies the right to impeach the Governor for criminal activity or disregard for the Confederate Constitution subject to a two-thirds majority vote;
  5. Grant unto the House of Representatives the right to try the Governor for the reasons of impeachment, and convict the Governor subject to a two-thirds majority vote, in which case the Governor shall be removed from office with immediate effect;
  6. Grant unto the House of Deputies the right to nominate an Acting Governor and unto the House of Representatives the right to confirm the nomination;
  7. The term of the Acting Governor shall end on the same date as the term would normally end;
  8. Grant unto the Governor the right to personal privacy, and the right to refuse to provide information that constitutes an intrusion to that right to personal privacy;
  9. Grant unto the Governor the right to appear before either House, or before a joint meeting of both Houses.
