The TREATY of BOSCHEM
between
THE KINGDOM OF BATAVIA
and
THE GARDEN OF KALGACHIA
The Kingdom of Batavia and the Garden of Kalgachia, finding themselves abutted, cordially acquainted and desirous of continuing friendly relations in a spirit of sovereign neighbourliness, commit by this document to codify their sentiments in law.
1. This document is an instrument of contracture, hereinafter named This Treaty, between the Kingdom of Batavia and the Garden of Kalgachia, hereinafter named the Parties, with the status of domestic and international law within and between the Parties.
2. Each Party commits to maintain a state of permanent peace with the Other Party, refraining from the use of armed force or of infrastructural, environmental or societal sabotage against the territory, citizens or assets of the Other Party, and to refrain from support of such actions initiated against the Other Party by any Third Party.
3. Each Party recognises the sovereign right of the Other Party to occupy and administer the full extent of those territories credited to the Other Party's name on the published register of the Micronational Cartography Society.
4. Each Party recognises the exclusive right of the Other Party to decree and enact laws and to undertake executive actions upon the Other Party's territory, and refrains from the assertion of any jurisdiction upon any person or entity on the territory of the Other Party, unless expressly permitted by the Other Party within the means of an extradition deal or similar agreement.
5. Each Party commits to maintain a civil dialogue with the Other Party upon matters of mutual interest through the regular liaison of accredited emissaries.
6. Each Party commits to establish and maintain compatible protocols for the security of, and passage across the Parties' common territorial border, without prejudice to the sovereign right of Each Party as exclusive legislator and administrator of their respective territories.
7. Each Party commits that any overflight of its airspace by aircraft registered upon the territory of the Other Party, whose source and destination are outside the jurisdiction of the Overflown Party and which make no intermediate landing upon the territory of the Overflown Party, shall be considered to fall outside the remit of customs or immigration regulations and wholly outside the jurisdiction of any Third Parties, without prejudice to the exclusive right of the Overflown Party to approve or deny such overflight as it sees fit.
8. Both Parties commit that where the agreed transference of goods or payments between their respective territories is obstructed through litigation or force by a Third Party, the aforesaid goods or payments shall be held securely within the territory of the Originating Party until such time as the obstruction is removed. During the period of obstruction the Receiving Party may draw the value of the obstructed goods or payments as a balance of collaterialised credit for subsequent trade with the Originating Party.
9. Provision exists for the amendment of This Treaty by mutual agreement of Both Parties, subject to re-signature and re-ratification in accordance with their respective domestic procedures.
10. Each Party is obliged, in the event of experiencing a revolution, recovery from extended hiatus, transition to successor state or similar profound break in continuity of governance, to provide the Other Party with confirmation of This Treaty's continued efficacy upon request.
11. This Treaty enters into force upon its signature and ratification by Both Parties in accordance with their respective domestic procedures.
12. This Treaty becomes void in its entirety upon the unilateral and formal renunciation of any of its terms by Either Party.
