Chidao Constitution

The Xianfa Constitution is no longer a viable representation of the current constitutional framework. I propose adapting some new document, the Chidao Constitution. It acknowledges what always was, and will always be, the divine right of the Emperor to rule the Empire as He sees fit. :kowtow:

Jingdao will remain an absolutist state under the guidance of the Chidao emperor, while I would like to see a document detailing how our institutions work, the Chidao emperor will not tolerate any document limiting his own powers, he rules as he sees fit.

Some of the more obvious offending sections:
The Emperor shall be the symbol of the State, the unity of the People and as Guiding Light to Eternal Salvation with whom resides sovereign power, deriving his position from the will of the people.
The emperor derives his position directly from the Gods.
a) The Emperor shall perform only such acts in matters of state as are provided for in this Constitution or Laws.
The emperor does as he pleases.
The people have the inalienable right to worship the Heavenly Light.
The people have the inevitable duty to worship the Heavenly Light.
The Heavenly Light shall be the highest organ of state power, and shall be the sole law-making organ of the State. He's aided in this task by the Imperial Councils, also known as the Chao Suweiai.
The Heavenly Light is not an "organ", we should rather say that the state is an extension of the will of the Heavenly Light.

I propose the following changes:

Chapter 1
Article 1:

The Emperor represents the Council of the Gods on Micras, he is the Heavenly Light that guides all the people towards salvation. The Jingdaoese people owe him their full allegiance and shall love him dearer than they love themselves or those who are close to them.

Article 3:

The Emperor shall be advised by the Grand Secretariat.

Article 4:

This article is unnecessary as the only part of it that is true is that the emperor may delegate his tasks. But this is obvious as there are no boundaries to what the emperor may do, if he wishes to do so.

Article 5:

When a regency is established, the regent shall not be able to assume all rights and privileges offered to the emperor, but only those that are granted to him by law.

Article 6:

Governors and viceroys are appointed by the emperor, or by a regent in case of a regency.

Article 7:

Unnecessary.

Chapter 2

Article 10:

All people residing on the soil of the Jingdaoese Empire are expected to direct their worship to the Heavenly Light with all their heart and all their soul. They shall worship no god beside Him. Any attempt to subvert the special role of the Heavenly Light by worshiping other Gods directly shall be punishable by death. The Grand Secretariat may offer tolerance towards foreigners living in our territory on a temporal basis, to practice their faith in a modest way without proselityzation.

Article 11:

All citizens are servants of the Heavenly Light. Citizens who take up public positions shall use these positions solely to promote the will of the Heavenly Light and will not use their position to further the interests of individuals or groups they affiliate with.

Perhaps the introduction still needs some change? It sounds rather 'democratic'...


We, the Jingdaoese people, acting through our representatives, determined that we shall secure for ourselves and our posterity the fruits of peaceful cooperation with all nations and the blessings of liberty throughout this land, and resolved that never again shall we be visited with the horrors of war through the action of government, do proclaim that sovereign power resides with the people and do firmly establish this Constitution. Government is a sacred trust of the people, the authority for which is derived from the people, the powers of which are exercised by the representatives of the people, and the benefits of which are enjoyed by the people. This is a universal principle of mankind upon which this Constitution is founded. We reject and revoke all constitutions, laws, ordinances, and rescripts in conflict herewith.

We, the Jingdaoese people, desire peace for all time and are deeply conscious of the high ideals controlling human relationship, and we have determined to preserve our security and existence, trusting in the justice and faith of the peace-loving peoples of the world.

We believe that no nation is responsible to itself alone, but that laws of political morality are universal; and that obedience to such laws is incumbent upon all nations who would sustain their own sovereignty and justify their sovereign relationship with other nations.

We, the Jingdaoese people, pledge our national honour to accomplish these high ideals and purposes with all our resources.
