Jingdaoese-Apollonian Union Act

THE JINGDAOESE-APOLLONIAN ACT

-- An Act to constitute the Union. --

Whereas it is desirable for the welfare and future progress of Apollonia that the several Jingdaoese territories therein should remain united under one Government in a legislative union under the Heavenly Crown;

And whereas it is expedient to make provision for the union of the Fourteen Zhou on terms and conditions to which they have agreed by resolution of their respective Governors and Representatives, and to define the executive, legislative, and judicial powers to be exercised in the government of the Union;

And whereas it is expedient to make provision for the establishment of provinces with powers of legislation and administration in local matters and in such other matters as may be specially reserved for provincial legislation and administration;

And whereas it is expedient to provide for the eventual admission into the Union or transfer to the Union of such parts of Jingdao as are not originally included therein;

Be it therefore enacted by the Emperor's most Excellent Majesty, by and with the advice and consent of the Jingdaoese-Apollonian People and Their Representatives:



Part I. Preliminary.

Article 1

This Act may be cited as the Jingdaoese-Apollonian Union Act, or the Union Constitution.


Article 2

In this Act, unless it is otherwise expressed or implied, the words “the Union” shall be taken to mean the Jingdaoese-Apollonian Union as constituted under this Act, and the words “House of Parliament,” or “Parliament,” shall be taken to refer to the the Parliament of the Union which consists of the Seanad.


Article 3

The provisions of this Act referring to the Emperor shall extend to His Majesty’s heirs and successors in the sovereignty of the House of Erasmii.


Part II. The Union

Article 4

The Government and Parliament of the Union recognises the Worship of the Emperor as sole official and supported state religion and sees it as part of the Union's culture and contributor to the national unity.


Article 5

The Emperor may at any time appoint a representative for the Union, who shall act as intermediary between the Crown and Union.


Article 6

Upon any Territory entering the Union, every other Act applying to any of those Territories as being self-governing lands with responsible government, shall cease to apply to that Territory, but as from the date when this Act takes effect every such Jingdaoese Act shall apply.


Article 7

1. The original Jingdaoese-Apollonian Union consists of following Zhou of Bangou (North Dalmacija), Qianjin (South Dalmacija), Xianbei, Qaoshan Jinkeai, Shengxianxia, Zhongji, Heliu, Zhijin, Zhaoqin, Gong, Nandao (Norfolk), Dongdao, Qundao.

2. Name changes, territorial changes or the acceptance of new land in the Union must be approved by a simple majority in the Seanad.

3. The Zhou, also called Provinces, are governed by a Governor. The Governor is elected every three months during Regional Elections from among its residents.

4. Counts and Governors can pass local legislation within their County or Zhou as long as this not goes against Union Law.

5. The Zhou are divided into Counties, governed by a Count. A Count can receive a noble title with the Emperor's consent.


Part III. Executive Government.

Article 8

1. The Grand Secretariat, serving as His Imperial Majesty's Government, acts in name of the Emperor.

2. The Imperial Chancellor, to be appointed by the Emperor and with the support of a majority in the Seanad, shall preside the Grand Secretariat, and supervise the conduct of its business. The formal title of the Chancellor is Diwang.

3. The Grand Secretariat holds responsibility for the actions of the Emperor. For this reason, a Decree of the Emperor concerning government matters shall be put before the Grand Secretariat for discussion, before its publication.

4. The Diwang must receive the support of a majority in the Seanad to assemble a government. In case a government falls and attempts to appoint a new Diwang fails, new regional elections will be held.


Article 9

Any proposed government Act shall be laid before the Imperial Yuan in the name of the Emperor, and they shall be advocated in the Yuan by members of the government, or by special commissioners.


Article 10

1. To the Emperor shall belong the right to prepare and publish the laws of the Empire. The decrees and ordinances of the Emperor shall be published in the name of the Emperor and its People. The emperor can refuse to sign laws, which will prevent them from coming into effect.

2. In case the Emperor is unable or unwilling to sign, the Diwang will be granted the power to sign laws.

3. In case neither the Emperor or Diwang are willing to pass an approved Act, the senior member of the Seanad shall be granted those temporary powers.



Article 11

1. The Diwang shall appoint state officials, require them to take the oath of allegiance, and dismiss them when necessary.

2. The Diwang can institute rules by approving and signing Imperial Decrees. These can not overrule decisions made by the Seanad.


Article 12

If Zhou of the Empire do not fulfil their constitutional duties, proceeding may be instituted against them by military execution. This execution shall be ordained by the Seanad, and enforced by the Grand Secretariat.


Article 13

The Diwang, nor any member of the government, can appoint or take away someone's noble status, even while acting as a representative of the Emperor. The appointment of nobility is a right of the Emperor.


Part IV. Seanad.

Article 14

1. The legislative power of the Union shall be vested in the Parliament of the Union, herein called Parliament, which shall consist of the Emperor and Seanad.

2. Daocheng shall be the seat of the Legislature of the Union.


Article 15

1. The Seanad shall consist of the Count of each County and the governor of each Zhou.

2. A Count receives one vote. A governor receives one vote. It is possible for a Representative to hold up to two votes.

3. The Seanad is presided by the Emperor, or in His absence by the Grandsire who is elected among its members. He opens, adjourns, and closes the meetings.


Article 16

The qualifications of a senator shall be as follows: He must:

a) be a Jingdaoese-Apollonian subject;

c) have received a county to govern.


Article 17

1. The President of the Seanad - called Grandsire - will be elected by absolute majority and is responsible for keeping order.

2. Each legislative period of the Seanad shall last 90 ASC. On special request, the Seanad can advise the Emperor to expand this time period with an extra ten days.

3. The Seanad may be dissolved by the resolution of the Grand Secretariat, with the consent of the Emperor.


Part V. The Senechal.

Article 18

1. The moderative power of the Union is vested in the Senechal.

2. The first Senechal of Jingdao shall be Jonas Win'Eth and he shall serve until zir resignation or death. Zir successors in the office of Senechal throughout time shall be appointed by the Seanad in accordance with law and custom.

3. The Senechal shall have veto power over legislation.


Part VI. The general provisions.

Article 19

Amendments of the Constitution shall be made by legislative enactment. They shall be considered as approved when these find approval with of at least 60% of the votes in the Seanad.


Article 20

The Senechal shall act as temporary legislative and executive power until a Seanad has started their first session. He shall be responsible for the necessary Lawmaking.
