STATE DEFENCE ACT

An Act to Provide for the Defence of the State and Related Issues

Be it enacted by the President with the advice and consent of the Parliament of Talenore, as follows:

Organisation
1. The armed forces of the State are composed of the State of Talenore Army, State of Talenore Navy, State of Talenore Air Force, State of Talenore Coast Guard, and State of Talenore Gendarmerie. Furthermore, the Special Operations Corps is a unit directly under the command of the President. The armed forces are collectively known as the Talenore Defence Force.

Mission
2. The mission of the Talenore Defence Force is to protect the territory and integrity of the State, deter aggression and counter any threat or attack towards the State.

Chain of Command
3. The President is ex officio Commander-in-Chief of the Talenore Defence Force.

4. The day-to-day operational command is vested in the Joint Headquarters (JHQ), headed by the Chairman of the JHQ, who also serves as Supreme Commander of the Talenore Defence Force.

5. Each service branch is headed by a Tactical Command, directly under the JHQ. The commanding officer of each service branch heads the respective Tactical Command.

6. The Supreme Commander, the commanding officers of each service branch, the commanding officer of the Special Operations Corps, a representative of the President and a representative of the State Defence Equipment Administration, constitute the governing board of the JHQ.

Equipment
7. The Defence Equipment Administration is responsible for procuring and evaluating military equipment for the TDF, in cooperation with the JHQ.

Conscription
8. All able-bodied citizens between the ages of 18 and 55 shall be available for conscription by the TDF. Each year, a class of citizens that have reached the elligible age shall be conscripted into one of the branches of the TDF for military training.

9. Each conscript shall serve at least 12 months.

10. Citizens that for religious reasons or because of a personal conviction cannot handle a weapon, shall serve in the civilian National Service, or in the TDF in a non-fighting capacity.

11. Citizens that refuse to serve in neither the TDF nor the National Service, shall be sentenced for refusal to serve to a fine and no more than two years imprisonment.

Overseas Deployment
12. The TDF may be deployed overseas on the invitation of a foreign power, an international organisation, to keep the peace in areas without government, or to assist after natural disasters. Parliament must approve any such deployment.

Presidential Deployment
13. The President may deploy the Special Operations Corps for up to 60 days, but must keep the Speaker and Prime Minister informed.

Prohibition against Civilian Use
14. The TDF may not be used for law enforcement within the State, nor may it be used for crowd control or any other such task involving civilians. The Gendarmerie is exempt from this provision.

TDF Assistance
15. The State Police Service, State of Talenore Gendarmerie or the State Fire and Rescue Service may request the support of the TDF in rescue missions or in the aftermath of natural disasters or other such events. Any TDF forces serve under civilian command during such support missions.

Law Enforcement
16. The TDF is supervised, investigated and enforced by the Defence Provost Service, a special branch of the Gendarmerie.

Jurisdiction
17. The Defence Provost Service has exclusive jurisdiction on military property and assets and regarding an allegation of criminal activity committed by a member of the TDF.

Security and Intelligence
18. The TDF is provided with security and intelligence services by the Defence Security and Intelligence Service, a branch of the Gendarmerie.

Delegation
19. The President may, with the advice of the Prime Minister, issue further regulations for the defence of the State, in conformity with this Act. This includes, but is not limited to, a military code of conduct, establishment of various ranks, rates and insignia, as well as orders of battle.

National Security Council
20. The President is advised in matters of national security by a National Security Council. It consists of the President, the Prime Minister, the Ministers responsible for defence and foreign affairs, as well as no more than two upstanding citizens appointed by the President, with the advice of the Prime Minister.
