By the Court of Session of the Court of the King's Chamber in the Year 1644,

A Court Decree


The Petitioner

On the Nineth Day of Elroqpinu in the Year 1644 a Petition regarding the Last Will and Testament of Dominus Thorgils Tarjeisson Einhorn Ettlingar Verion (hereafter "Thorgils Tarjeisson") by Aqa Daniyal Sikander Dravot. The said Petition was registered by this Court as Petition No. 1 of 1644.

Statement of the Case

In his Petition Aqa Daniyal Sikander Dravot requested this Court to read the Last Will and Testament of Thorgils Tarjeisson grant authority for the disbursement of monies, properties and offices, by His Riverine Majesty's gracious leave, except for payments to Adam Ayreon-Kalirion and Ludovic Alixion-Verion, who according to him, must, under natural law, be debarred from being beneficiaries from Thorgils Tarjeisson's will on account of their participation in the circumstances leading to his death.

Jurisdiction

This Court has jurisdiction over this matter under the First Article of the Fourth Chapter of the Constitution of the Elwynnese Union.

Evidence

The Court has heard and considered the following pleadings and written and oral evidence relevant to a decision on this matter:
  1. The written submission to this Court by Aqa Daniyal Sikander Dravot;
  2. The announcement of the death of Thorgils Tarjeisson by Tokaray al-Osman; and
  3. An affadavit filed in camera with this Court by the Mango Rangers containing a surveillance report concerning the circumstances surrounding the death of Thorgils Tarjeisson.
Findings

Having considered the evidence this Court finds that it is safe to assume that Thorgils Tarjeisson has died.

To the Court it is also perfectly clear that Adam Ayreon-Kalirion and Ludovic Alixion-Verion were major and very willing participants, both preparatory and executionary, in the creation of the circumstances which led to the untimely death of Thorgils Tarjeisson.

For the foregoing reasons,

It is ordered by this Court that the Petition filed with this Court by Aqa Daniyal Sikander Dravot on the Nineth Day of Elroqpinu in the Year 1644 is granted and that in consequence thereof the Last Will and Testament of Dominus Thorgils Tarjeisson is hereby released from the National General Register of the Elwynn by this Court and read by the same.

This Court also confers authority for the disbursement of monies, properties and offices in accordance with the provisions of the Last Will and Testament of Thorgils Tarjeisson, save for the payments that were to be made to Adam Ayreon-Kalirion and Ludovic Alixion-Verion. As the two of them were major and very willing participants in the creation of the circumstances leading to the untimely death of Thorgils Tarjeisson, it would undisputedly constitute unjust enrichment if they were to receive anything from the Estate of Thorgils Tarjeisson.

The Court hereby orders that the sums which were earmarked for Adam Ayreon-Kalirion and Ludovic Alixion-Verion in the Last Will and Testament of Thorgils Tarjeisson shall be awarded to the Elwynnese Inheritance Fund.

Issued at the Palace of Krull by the Hand of the King of the Jewel of the Many Facets and under the Seal of the Elwynnese Union this Twelfth Day of Elroqpinu in the Year 1644 corresponding to the Thirtieth Day of the Month Vidiland in the Sixteenth Year of the Second Viking Age.
