CHARTER OF THE JINGDAOESE EMPIRE




PREAMBLE
The Provisional Government of Jindao, representing the Brave Descendants of the Apollonian and Jingdaoese Peoples whom lived on its Sacred and Blessed Land conclude an eternal alliance for the protection of the territory of the Empire, and of the law of the same, as well as for the promotion of the welfare of the Jingdaoese people.

This Confederation shall bear the name of the Jingdaoese Empire, and shall have the following constitution:



I. TERRITORY

Article 1

1. The territory of the Empire shall consist of the States of Saksenland, Vervollkomnung, Dalmacija, Gong, Batavia, Greater Bosania, Sweden, Rulak-Eblis, Tyrenia and the Eastern Isles (and Melangia).

2. The Jingdaoese Empire, also referred to as Empire of Jingdao, is one and indivisible.

3. The capital of the Empire is located at Epoli.

4. A coronation of the Empire takes place in Apollo City, under supervision of the Magister of the Holy Catologian Church.

5. Each State has the right to use a certain government type, with approval of the Emperor. Exception are the Imperial Cities, which are brought under the States' authority but retain a certain grade of autonomy.

6. Every State must have a functioning administration with an elected council and a Prime Minister serving as the head of its government.


II. LEGISLATION OF THE EMPIRE

Article 2

1. Within said territory, the Empire shall have the right of legislation according to the provision of this Constitution, and the laws of the Empire shall take precedence of those of the individual provinces.

2. The laws of the Empire shall be rendered binding by proclamation, such proclamation to be published in a journal devoted to the publication of the laws of the Empire. If no other period shall be designated in public law for it to take effect, it shall take effect on the first day after the day of its publication in the Lawbook in Epoli.


Article 3

1. There is one citizenship for all Jingdao, and the citizens or subjects of each Constituent State of the Empire shall be treated in every other State thereof as natives. They shall have the right of becoming permanent residents, of carrying on businesses, of filling public offices, and may acquire all civil rights on the same conditions as those born in said States.

2. All Jingdaoese in foreign countries shall have equal claim upon the protection of the Empire.


Article 4

1. The legislative power of the Empire shall be exercised by the Imperial Council, consisting of the Imperial Assembly and the Seanad. A majority of the votes of the Imperial Assembly shall be necessary and sufficient for the passage of a law.

2. The legislative power of the Empire can also be exercised by the President of the Empire through Decrees.

3. Laws shall have precedence over Decrees, except when the President of the Empire promulgates a Decree to avert a national catastrophe.


III. IMPERIAL ASSEMBLY

Article 5

1. The Imperial Assembly shall consist of the representatives of the People of the Empire, among whom the votes shall be divided in such a manner as that:
Saksenland: 112
Vervollkomnung: 76
Batavia: 48
Gong: 19
Dalmacija: 106
Greater Bosania: 12
Eblis-Rulak: 8
Tyrenia: 3
Eastern Isles (and Melangia): 3
Epoli: 1
Apollo City: 1
Tyrasia: 1
Curragh: 1
TOTAL: 391

2. No individuals are elected during National Elections. Voters are only able to vote on parties. Each party must decide for itself to whom the seats go eventually.

3. Each State has a separate Election Round. In each State 20% of the votes are randomly given to a participating party.

4 .The members of the Assembly shall be the representatives of the entire people, and shall not be bound by orders and instructions from their constituents.


Article 6

1. The Assembly shall have the right to propose laws within the jurisdiction of the Empire , and to refer petitions, addressed to it, to the the President of the Empire.

2. The Assembly shall pass a resolution by absolute majority.


Article 7

1. The President of the Imperial Assembly will be elected by a simple majority and is responsible for keeping order.

1. Each legislative period of the Assembly shall last 90 ASC. The Assembly may be dissolved by the resolution of the Grand Secretariat, with the consent of the Emperor.

2. A member of the Assembly must have fulfilled his military service to the Empire or have served the Empire in an equivalent way.


Article 8

1. The Election Committee, responsible for organising elections, will be selected by the Grand Secretariat.

2. The members of the Assembly shall be elected by all landholders of Jingdaoese citizenship or Citizens with sufficient wealth to contribute to the economical development of the Empire.


IV. PRESIDENT OF THE EMPIRE

Article 9

1. The Provisional Government of Jingdao will appoint the President of the Empire who shall succeed Emperor Mordechai III, and whom shall hold the title of Emperor of Jingdao.

2. The Emperor ascends the Heavenly Throne, which will symbolically be represented by the old Apollonian Two-Headed Eagle Throne. The Emperor will, however, not receive the title of Heavenly Light.

3. The Emperor appoints his successor or, when no successor was appointed, or if the one who was appointed is unable or unwilling to ascend the Heavenly Throne, the Seanad will elect a new one, preferably from among the members of the same Dynasty.

4. The Emperor shall represent the Empire among nations, declare war, and conclude peace in the name of the same, enter into alliances and other conventions with foreign countries, accredit ambassadors, and receive them.

5. For declaration of war in the name of the Empire the consent of the Assembly shall be required. Except in case of an attack upon the territory of the Empire or its coasts.

6. So far as treaties with foreign countries refer to matters which are to regulated by the Legislature of the Empire, the consent of the Assembly shall be required for their ratification to render them valid.


Article 10

The Emperor shall have the right to convene the Seanad, and to open, adjourn, and close it.


V. GRAND SECRETARIAT OF THE EMPIRE

Article 11
1. The Grand Secretariat, serving as His Majesty's Government, acts in name of the Emperor.

2. The Imperial Chancellor, to be appointed by the Emperor, shall preside the Grand Secretariat, and supervise the conduct of its business.

3. The Grand Secretariat holds responsibility for the actions of the Emperor. For this reason, a Decree of the Emperor concerning government matters shall be put before the Grand Secretariat for discussion, before its publication.


4. The Chancellor must receive the support of a majority in the Assembly to assemble a government. In case a government falls and attempts to appoint a new Chancellor fails, elections will be held.


Article 12

Any proposed government Bills shall be laid before the Assembly in the name of the Emperor, and they shall be advocated in the Assembly by members of the government, or by special commissioners.


Article 13

1. To the Emperor shall belong the right to prepare and publish the laws of the Empire. The decrees and ordinances of the Emperor shall be published in the name of the Emperor and its People. The emperor can refuse to sign laws, which will prevent them from coming into effect.

2. In case the Emperor is unable to sign, the Chancellor will be granted the power to sign laws. All laws signed by the Chancellor can be reverted by the Emperor once he regains his ability to oversee the legislative process.


Article 14

The Emperor shall appoint state officials, require them to take the oath of allegiance, and dismiss them when necessary.


Article 15

If States of the Empire do not fulfil their constitutional duties, proceeding may be instituted against them by military execution. This execution shall be ordained by the Assembly, and enforced by the Grand Secretariat.


Article 16

1. In absence of the Emperor, the Chancellor of the Empire will act as temporary President of the Empire.

2. The Chancellor, nor any Minister, can appoint or take away someone's noble status, even while acting as replacement of the Emperor.


VI. Seanad

Article 17

1. The Seanad shall consist of the high nobility of each State.

2. High nobility shall be defined as those titles of nobility that can only be awarded by the Emperor, being those of king, duke, prince, marquis and landgrave along with any variation using a pre- or postfix.

3. Each Senator shall have one vote.

4. The Seanad is presided by the Emperor. As mentioned in Article 10, he opens, adjourns, and closes it.


Article 18

The Seanad shall take action upon:

a) the lack of a judge or jury in lawsuits. The institution will act as supreme court.
b) The defects which may be discovered in the execution of the laws of the Emperor, or of the provisions and regulations heretofore mentioned.
c) necessary amendments of the Constitution.


VII. GENERAL PROVISION

Article 20

Amendments of the Constitution shall be made by legislative enactment. They shall be considered as approved when these find approval with 75% of the Seanad and receive support of at least 60% of the votes in the Imperial Assembly.
