Instrument of Government of the Elian Lands

INSTRUMENT OF GOVERNMENT

We, ADAM, Prince and Lord of Walstadt and Elijah’s Rest, etc, etc., hereby make known that We adopt and confirm this Instrument of Government for the Elian Union, which, word for word, follows:

1. ON POWERS

1.1 All legislative, executive and judicial powers in the Union that are afforded it under the Caprine Code are exercised by the Prince, Adam Anushiruwân Hilding Ayreon-Kalirion ibn al-Majeed bin Sathrati of Waffel-Paine, with the advice of the Houses of Nobility and Chivalry.

1.1 In the event that the Prince is succeeded by a woman, she shall be titled Princess. All instances of Prince in this Instrument shall then be construed to mean Princess.

2. ON SUCCESSION

2.1 The right to succession to the throne of the principality is vested in the descendants of Elijah Ayreon-Kalirion of Waffel-Paine's issue in direct line of descent. In this connexion, older siblings and their descendants have precedence over younger siblings and their descendants. No difference shall be made between adopted children and biological ones, neither whether children were born in marriage or outside it, or between men and women.

2.2 Should there be no person holding a right under point 2.1 of this Instrument, the right of succession to the throne of the principality shall be vested in Daniel Tårbaek Lla'i Kalirion's issue in direct line of descent. In this connexion, older siblings and their descendants have precedence over younger siblings and their descendants. No difference shall be made between adopted children and biological ones, neither whether children were born in marriage or outside it, or between men and women.

2.3 Should there be no person holding a right either under point 2.1 or 2.2 of this Instrument, the Houses of Nobility and Chivalry shall, sitting as a grand committee, enact a law governing succession, and elect, from among its members, a new Prince.

2.4 The Houses of Nobility and Chivalry shall, upon the death or abdication of the Prince, name the new Prince according to Law.

2.4 In the absence of the Prince, the most senior of the Lord President of the House of Nobility and the Chairman of the House of Chivalry shall take on the reins of government until the Prince’s return.


3. ON THE HOUSE OF NOBILITY

3.1 The nobility of the Union shall be of equal rank, and its titles lands shall be restricted to Walstadt and Light, and the rank of nobility is Lord for men and Lady for women. The Prince confers the dignity of nobility and peerage on persons. When a nobleman or noblewoman dies, the dignity and peerage shall pass to his or her issue in direct line of descent, with older siblings and their descendants having precedence over younger siblings and their descendants, with no difference being make between adopted and biological children, not between children born in marriage or outside it, or between men and women.

3.2 The nobility shall, as the House of Nobility, meet from time to time to advise the Prince on matters pertaining to the government of the Union and on matters affecting Walstadt and Light.

3.3 When needed, the House of Nobility shall make rules for its own order and procedure.


4. ON THE HOUSE OF CHIVALRY

4.1 The House of Chivalry consists of an equal number of Knight-Monks of the Holy Order of the Cult of Elijah as there are Nobles in the House of Nobles. Every year, an Assembly of Knight-Monks shall elect the members of the House of Chivalry.

4.2 The House of Chivalry shall meet from time to time to advise the Prince on matters pertaining to the government of the Union and on matters affecting the territory of Elijah’s Rest.

4.3 When needed, the House of Chivalry shall make rules for its own order and procedure.



5. ON THE INSTRUMENT

This Instrument of Government is issued from the hand of the Prince. It may however only be amended, upon the motion of a member of the nobility, by the House of Nobility, never counting the Prince's vote, but attaining the assent of the House of Chivalry and then the Prince's assent in a decree of promulgation of such amendment.


And so it is done, and signed by Us, in the Court of the Whales in the city of Kujirashi-Walstadt, this twentieth day of Blumuar, in the year one thousand and six hundred and thirty-eight.
