PETITION FOR CONSTITUTIONAL REVIEW RE ELECTION OF PRINCE
SUMMARY
Doubt exists over the constitutionality of the princely election due to:
(1) The removal of the Prince by mere motion instead of by impeachment, contradictory to Section VII of the Rules of the Senate; and
(2) The apparent acceptance of Mr Rakira's vote on electing the illegal replacement Prince after the period of votes had closed.
The Court is thus implored to rule on these incidents and issue an injunction against the declaration of a victor in the election.
TIMELINE OF VOTE
1. President moves to remove Deimos Jasonides as Prince and elect Nathaniel Ayreon in stead.
2. Lady Miľarna moves to suspend the rules and proceed to vote immediately. Mr Luuis seconds the motion.
3. Vote begins.
4. Mr Luuis votes for removing Lord Jasonides and against installing Mr Ayreon.
5. Lady Miľarna votes for removing Lord Jasonides and abstains on the question of installing Mr Ayreon.
6. His Imperial Niftiness the Kaiser votes against removing Lord Jasonides and for installing Mr Ayreon.
7. President closes vote. Lord Jasonides is overturned; the question of installing Mr. Ayreon ends without plurality. President breaks neutrality and votes for this question, thus "installing" him as prince.
8. Lady Miľarna moves to overturn the election. Mr Luuis seconds the motion.
9. Mr Rakira voices his support for Mr Ayreon.
10. President interprets Mr Rakira's support as an ex post facto vote and summarily rejects Lady Miľarna's motion.
REQUEST FOR INJUNCTION
The Court is requested to make an injunction against the results of the "election" until rulings (see below) have been made. The effect would be to suspend the declaration of results of the removal and election, and prevent under penalty of law the Senate making any further such removals and/or elections, until such time that the Court has ruled.
REQUESTS FOR RULINGS
1. The Court is implored to rule on the legality under the law of the removal of a Prince by mere motion.
2. The Court is implored to rule on Lady Isurui's acceptance of Mr Rakira's ex post facto vote.
3. The Court is implored to rule on the legality under the law of the President voting in an election.
4. The Court is implored to rule on the combined effect of the rulings of 1-3 will have on the election, with particular concern to the legality of the removal and election itself.
